More Texas Police Work - Man arrested for taking pictures at Octoberfest

Photography in a public place is not illegal. Southlake police, however, said the nature of the pictures Vogel took violated state law.

"You're committing an offense if, a) you're taking a picture of a person who hasn't given you consent to do so, and b) that picture is for the sexual gratification of any person," Douglas said.
Translation: the police think too many photos were of fully clothed asses and breasts.

I'm sorry, the people were in public, the camera wasn't hidden, but the police decided he may have been taking too many ass and breast shots. He also took pictures of children. I watched the news report and read several accounts and unless there is something added that is what this about. I think this will be a difficult case to prove.

This is similar to the Houston case below where the police said if the packages said novelty item or massager they were fine but because some manufacturers were honest and said they were for sexual use they arrested the sales clerk for selling them.

These are laws passed by people scared of sex or people having fun. Pretty much the same law, having devices or images whose purpose is sexual pleasure.

I feel I have to add that taking pictures of children's asses in a public place is pretty sick but I don't see how it is something that needs legislation. i guess I wouldn't make a good Southern Baptist.
